From Gibbons Company's Interactions with You: We collect information from and about you and your transactions and other interactions with us. This may include, but is not limited to, when you visit our Site or Stores, use the Services, create an online account with us, make a purchase, sign up for our emails, participate in contests or other promotions, participate in a product review, survey, or other similar programs, send a gift or virtual gift card to a person, sign up for our Gift Registry, join a clientele list, sign up for personal shopping or otherwise contact us. The personal information we collect may include your name, address, email address, telephone number, or other contact information, birthday, other demographic information, your interests, and preferences.
 
 If you make a purchase from us, online and/or in-store, we may also collect a credit or debit card number or other financial information, CVV, and billing address. delivery address, telephone number, email address and payment or gift card information. Information You Provide About a Third Party: If you send someone else a communication from the Services (such as sending a gift or virtual gift card), we may collect information such as that person's name, telephone number, email, and/or delivery address for the purposes of facilitating the sending of the gift or virtual gift card.

Q: What information does Gibbons Company sell or share with others?
A: Gibbons Company will never sell or rent your personal information to third parties. Gibbons Company shares personal information with others to be able to improve our service and offerings to you and to enable the extension of the Gibbons Company brand and experience beyond our stores, sites, or Services. In addition, Gibbons Company may share personal information we collect from and about you in the following ways:
 
Gibbons Company Family of Companies: We may share collected information within the family of companies affiliated with Gibbons Company. This includes Gibbons Company, Gibbons Home Store, M•A•C Bermuda, The Perfume Shop, and any future additions to the companies owned or operated by Gibbons Company Ltd (all together the “Gibbons Company Family of Companies,” “we” “us” or “our”).
 
Co-Marketing Partners: Certain areas of the Services may be provided to you in association with third parties, such as companies that provide products and services, rewards programs, conduct joint sales programs, contests, promotional campaigns, and other jointly sponsored events. Such Services will identify the third party. If you elect to register for any products and/or services provided during the Services, you either will be providing your information to both Gibbons Company and such third party, or Gibbons Company might share your information directly with such third party for that third party to fulfill their products and our products and services directly with you.
 
Fraud Detection and Prevention: When you make a purchase, we may share your personal information with our fraud prevention partner to help us detect and prevent fraudulent transactions. This personal information may include your first and last name, shipping and billing address, email address, partial payment card information, transaction-level details, as well as your IP address and other information about your device (“Gibbons Company Customer Data”). Our fraud prevention partner will incorporate Gibbons Company Customer Data into its fraud protection technology and combine such data with other customer data our fraud prevention partner receives from its clients as well as other third-party data sources to help its clients detect and prevent fraudulent transactions.

Legal Disclosures; Safety: Gibbons Company and its service providers may disclose the information we receive from and about you to comply with a legal obligation; to provide information to law enforcement and other governmental authorities in accordance with applicable law (which may include lawful access by Bermuda, United Kingdom, Canadian, US or other foreign governmental authorities, courts or law enforcement agencies), and when we believe in good faith that the law requires or permits it. We also reserve the right to share information with legal authorities and other companies for fraud protection debt collection and credit risk reduction, to detect any technical or security vulnerabilities, to enforce our Terms & Conditions or other applicable policies, or to otherwise protect the rights, property, safety, or security of third parties, users of the Services, Gibbons Company, or the public.
 
Service Providers: We use third-party “service providers” to perform certain services on our behalf when the information is necessary for them to perform their duties such as sending communications, hosting the Site, operating certain features or to manage and analyze data and our advertising effectiveness. These third-party service providers are prohibited from using personal information for any other purpose and are required to comply with all applicable laws and requirements, which may include Payment Card Industry Data Security Standards if they are processing or transmitting payments for the Gibbons Company Family of Companies.
 
Aggregate or Anonymous Non-Personal Information: We may also share aggregate or anonymous information with or to our service providers or other third parties for their marketing or analytics uses or for other lawful purposes. This type of non-identifiable and aggregate information cannot be used to identify you personally.  

Q: How can I access or update my information?
A: If you have registered for an account, you may also view and update your account information by logging into the "Your Account" section of the Site. Once logged in, you can view or update your name, address, telephone number or email address.  You may also request these changes at any Gibbons Company Point of Sale locations.
 
 You may also request access, update, and correct inaccuracies in your personal information in our custody and control, subject to certain requirements under Bermuda's Personal Information Protection Act 2016 ("PIPA"), by emailing privacy@gibbons.bm We may request certain personal information for the purposes of verifying the identity of the individual seeking access to their personal information records.

Q: What choices do I have about receiving communications from Gibbons Company?
A: To receive promotional offers from the Gibbons Company Family of Companies, you can sign up on our Site, when you register for an account or make a purchase or provide your details at any Point of Sale. We provide our customers with the opportunity to "opt out" of receiving emails other than those for purposes directly related to placement, processing, fulfillment or delivery of a product order or your transactions with us. We provide you with the following options if you prefer to "opt out" of receiving information or materials that we think may be of interest to you:
  • Point of Sale: At the Point of Sale, you can inform us that you do not wish to receive our promotional communications.
  • Email Newsletters: At all times, you have the option of "opting out" of receiving promotional emails only by clicking the "unsubscribe" link in any of the promotional emails you receive.
  • Other Contact: In all cases, you may contact us in relation to privacy related matters at privacy@gibbons.bm
  • If you receive marketing communications from one or more companies within the Gibbons Company Family of Companies, you must opt-out individually from each of the companies from which you are receiving company-specific marketing communications.
  • In addition, opting out from communications does not stop tracking through cookies.  This would be managed as explained in the section “What are my tracking options?”
Q: What about children's privacy?
A: Protecting children's privacy is important to us, and the Site is not intended for children under the age of fourteen. We do not direct the Site to, nor do we knowingly collect any personal information from, such children. If Gibbons Company learns that a child under the age of fourteen has provided personal information to the Site, it will use reasonable efforts to remove such information from its files.

Q: What about security?
A: We have taken certain physical, administrative, operational, and technical steps to safeguard the information we collect from and about our customers and Site visitors. While we make every effort to help ensure the confidentiality, integrity and availability of our network and systems, we cannot guarantee our security measures. When you enter information such as credit card information on our forms, we encrypt the transmission of that information.

We take your privacy rights seriously and take every reasonable measure and precaution to protect and secure your personal data. We work hard to protect your personal information from unauthorized access, alteration, disclosure, or destruction and have several layers of security measures in place. We cannot however guarantee the absolute security of your information as no information system can be 100% secure. Additionally, we are not responsible for the security of information you transmit to us over networks that we do not control, including the Internet and wireless networks

Q: What about other websites?
A: Our Site may include links to third-party websites that are affiliated with Gibbons Company. These websites may send their own cookies to visitors, collect data or solicit your information. The privacy policies of these other websites may be very different from our policy. We are not responsible for the privacy practices of these other websites and cannot guarantee the security of any personal information you provide to or that is collected by such third-party sites.

Q: For how long and where is my data stored?
A: Your personal information may be stored for as long as is reasonably necessary to perform the purposes listed under "How does Gibbons Company collect and use the information?" and as otherwise required to meet our PIPA obligations. For example, if you make a purchase, we will store any personal information associated with that purchase as long as required to fulfill the order and meet our PIPA obligations, process any returns, provide customer service and support an enhanced shopping experience, remember your preferences for future interactions, or be able to provide you with tailored offers or services. The servers and databases in which information may be stored or processed by Gibbons Company and its affiliates and service providers may be located in the U.K., U.S., Canada or other jurisdictions outside the country from which you accessed the Services and, in a country, where the data protection and other laws may differ from your country of residence. In the event personal information is transferred to the U.S. or other foreign jurisdictions, it will be subject to the laws of that jurisdiction and may be disclosed to or accessed by the courts, law enforcement and governmental authorities in accordance with those laws. If you unsubscribe from promotional materials that you were receiving from Gibbons Company, we will delete your personal information from the database from which our promotional information is sent.  We review this information semi-annually. In order to begin receiving promotional materials you would have to opt in again.

Q: How does Gibbons Company communicate changes to this Notice?
A: Any changes to our Privacy Notice will be noted on the privacy page of the Site with a link to the revised Privacy Notice. Your continued use of the Site following posting of changes to these terms will mean you accept these changes.
